Welcome to Portalala ("Portalala", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your use of the Portalala mobile application, website, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, downloading our app, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

You must be at least 18 years old to use Portalala. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into binding agreements.

2. Service Description

Portalala is a real estate platform that connects property buyers, sellers, renters, and real estate professionals. Our Service includes:

  • Property listings for sale, rent, and requests
  • Property search and discovery tools
  • Communication between users and real estate agents
  • Property booking and viewing appointments
  • Real estate agency management tools

IMPORTANT: Portalala acts as a platform facilitating connections between users and does not own, sell, or rent any properties listed on the Service. We are not a party to any transactions between users.

3. Account Registration and Security

3.1 Account Creation: To access certain features, you must create an account providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibilities:

  • You are responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use or security breach
  • We reserve the right to suspend or terminate accounts that violate these Terms
  • You may not share your account with others or create multiple accounts
  • Provide accurate contact information and keep it updated

4. Property Listings

4.1 Listing Content: Users who list properties agree to:

  • Provide accurate, complete, and truthful information
  • Upload genuine photos of the property
  • Have legal authority to list the property
  • Update listings promptly when information changes
  • Comply with all applicable real estate laws and regulations

4.2 Prohibited Listings: You may not list:

  • Properties you do not have authority to represent
  • Fake or fraudulent properties
  • Properties for illegal purposes
  • Discriminatory listings that violate fair housing laws

4.3 Content Moderation: We reserve the right to remove listings that violate these Terms or applicable laws without prior notice.

5. User Conduct

When using Portalala, you agree not to:

  • Post false, misleading, or fraudulent content
  • Harass, intimidate, or discriminate against other users
  • Attempt to bypass our payment systems or fees
  • Scrape or harvest data from the platform
  • Impersonate others or misrepresent your identity
  • Violate any local, state, national, or international law
  • Interfere with the proper functioning of the Service

6. Communications

Our Service facilitates communication between users:

  • Messages should be respectful and professional
  • Do not share personal financial information via messages
  • Report suspicious or inappropriate communications
  • We may monitor communications to ensure compliance with Terms

7. Property Transactions

7.1 Third-Party Transactions: Portalala facilitates connections but is not involved in actual property transactions. Users are responsible for:

  • Conducting proper due diligence on properties
  • Verifying property ownership and legal status
  • Negotiating terms and conditions directly
  • Securing appropriate legal representation
  • Complying with all applicable real estate laws

7.2 No Warranty: We do not warrant or guarantee:

  • The accuracy of property listings
  • The quality or condition of listed properties
  • The reliability of other users
  • That transactions will be completed successfully

8. Fees and Payments

8.1 Platform Fees: Certain features may require payment. Fees are clearly displayed before you make a purchase.

8.2 Payment Processing: Payments are processed through third-party payment providers. We do not store your payment information.

8.3 Refunds: Refund policies vary by service. Contact support for refund requests.

9. Intellectual Property

9.1 Our Property: The Portalala platform, including its design, features, and content, is protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our proprietary content
  • Reverse engineer or decompile the app
  • Use our trademarks without written permission
  • Create derivative works based on our Service

9.2 User Content: You retain ownership of content you post but grant us a license to use, display, and distribute it within the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • PORTALALA IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED
  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS
  • WE ARE NOT LIABLE FOR DISPUTES BETWEEN USERS OR FAILED TRANSACTIONS

11. Indemnification

You agree to indemnify and hold harmless Portalala from any claims, damages, or expenses arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you post on the platform
  • Your property transactions or interactions with other users

12. Termination

12.1 Your Right to Terminate: You may close your account at any time through the app settings or by contacting support.

12.2 Our Right to Terminate: We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activities
  • Fail to pay required fees
  • Abuse or harass other users or staff

13. Dispute Resolution

13.1 Informal Resolution: Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at support@portalala.com.

13.2 Governing Law: These Terms are governed by the laws of North Macedonia.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance of the modified Terms.
